Use of services
By accessing or using the website, app, or related services, you agree to these Terms of Use and all applicable Farming Ledger policies. Farming Ledger is a farm management and record-keeping platform designed to assist users in tracking farming activities, operational information, and financial records. The services are provided for informational, administrative, and organisational purposes and do not constitute financial, investment, tax, legal, accounting, or other regulated professional advice. You use the services entirely at your own risk.
Important notice
These policies contain provisions that limit the risk, liability, and obligations of Farming Ledger and Van Der Merwe Collections, constitute assumptions of risk by you, and may require you to indemnify us. By using the services, you confirm that you have been given adequate notice of these provisions and accept them as material terms.
Eligibility and acceptable use
You may use the services only if you are at least 18 years of age and legally competent to enter into binding agreements. You must provide accurate account information, keep credentials secure, and comply with all applicable laws. You may not misuse the services, interfere with their operation, attempt unauthorised access, upload unlawful or infringing content, submit false information, scrape or copy the services without permission, or use the services in any manner that may expose Farming Ledger or third parties to risk, liability, or harm.
User content and intellectual property
You retain ownership of content submitted by you, but grant Farming Ledger and Van Der Merwe Collections a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, process, reproduce, adapt, display, publish, and use that content for operation, maintenance, support, improvement, security, and enforcement of the services. All intellectual property rights in the services, excluding user content, remain vested in or licensed to Farming Ledger or Van Der Merwe Collections.
Third parties and AI-assisted code
The services may rely on or integrate with third-party platforms, processors, infrastructure, or tools, and Farming Ledger is not responsible for their acts, omissions, outages, terms, policies, or failures. Portions of the app and site code may be developed, assisted, or reviewed using AI coding tools and open-source software components. Although we apply testing, validation, and review processes, such tools and components may contain defects, inaccuracies, vulnerabilities, or licensing conditions.
Warranty, liability and indemnity
To the maximum extent permitted by law, the services are provided on an "as is" and "as available" basis without warranties of any kind. Farming Ledger is developed from practical farming and operational experience and is not an accredited financial adviser, accountant, tax practitioner, legal practitioner, or licensed professional adviser. We disclaim liability for losses arising from reliance on the services, user decisions, interruptions, inaccuracies, system defects, farming outcomes, financial outcomes, or third-party services. You agree to indemnify and hold harmless Farming Ledger, Van Der Merwe Collections, and their officers, employees, contractors, agents, licensors, and affiliates against claims arising from your use of the services, breach of these policies, unlawful conduct, or infringement of rights.
Subscriptions and payments
Access to paid features is provided on a recurring monthly subscription basis unless expressly stated otherwise. By subscribing, you authorise Farming Ledger or its nominated third-party payment processor to charge applicable subscription fees, renewals, taxes, and other disclosed charges to your selected payment method on a recurring basis until cancellation. You are responsible for keeping payment details valid and ensuring sufficient funds are available.
Refunds and cancellation
All fees are payable in advance and, to the fullest extent permitted by applicable law, are non-refundable, non-transferable, and not subject to set-off or deduction. Cancellation prevents future recurring charges only and does not entitle you to a refund, credit, or pro-rata reimbursement for any current or partially used billing period, except where expressly required by applicable law. Subscriptions renew automatically month-to-month until cancelled by you or terminated by us.
Payment processors and disputes
Payments are processed by independent third-party processors, and Farming Ledger does not store full card details. Billing timing, authorisations, failed payments, reversals, chargebacks, payment method declines, and processor-related delays may affect access. If a payment is reversed, charged back, disputed, or dishonoured, we may suspend or terminate access, recover outstanding amounts, and pursue lawful remedies.
Governing law and notices
These Terms of Use are governed by the laws of the Republic of South Africa. Nothing in these policies excludes any right that cannot lawfully be excluded under applicable law, including mandatory consumer rights where they apply. If any provision is unlawful or unenforceable, the remaining provisions remain in force. All formal legal notices must be sent to info@vdmfarming.co.za.
